NASTY THERE AND NASTY HERE

Labour would have it that those New Zealanders deported from Australia under S501 of the Migration Act having failed the 'character' test were innocents abroad being dealt to by a cruel and uncaring Aust government aided and abetted by a heartless NZL government.

The reality is somewhat different.   Just 73 days after the first deportees arrived back in the country and in the briefing papers released to the incoming Minister of Police (Judith Collins) it is revealed that already one-third of them have gone on to commit a range of crimes here ... some serious.   The Police are expecting that figure to rise to 55%.

Kelvin Davis was of course the poster-boy for the deportees.   It will be blood sports taken to a cruel and unusual level watching Collins eviscerate him in the House over his support for some quite nasty people.

Changes to Australia’s Migration Act 1958 have significantly increased the numbers of New Zealanders being removed from Australia for criminal convictions and on character grounds. Deportee reoffending that has come to Police’s attention since December 2014 is at around 30 percent, including sexual and violent offending. Police expects reoffending rates to be as high as 55 percent after two years. Prime Ministers agreed in February 2015 to develop an arrangement to share information to reduce the risk of returning offenders. Police led negotiations between the Australian Department of Immigration and Border Protection and New Zealand agencies on an information sharing Arrangement to provide timely and relevant information between countries before a person is removed. The Arrangement was announced by Ministers Adams and Woodhouse on 30 September 2015 and is currently being trialled. On 18 November 2015, New Zealand enacted new legislation under urgency providing Police with powers to require information and DNA samples from returning offenders, and enabling supervision of eligible returning offenders. Police determines whether offenders are eligible based on their sentence length overseas and serves notice on offenders on their arrival in New Zealand. The regime is administered by the Department of Corrections who monitors those offenders on parole-type conditions. Police leads the cross-agency operational response which includes justice, social and health sectors. Australia is currently using charter flights to remove detainees volunteering to return, with three flights, carrying 10-15 detainees, received over November and December.

Mr Davis has history ... including not having the guts to repeat outside the House his allegation that JC's husband was a director of a company involved in the illegal export of swamp kauri. That canard was repeated in the media who, under the threat of legal action, were forced to issue an retraction and an apology and stump up with his legal costs.

Egg on the face stuff given that Labour had changed the law in 2004 making this possible.

Davis has a lot to answer for and I suspect this will get personal. Davis does have a defense ... after all he is Ngapuhi and one of Kingi's and Hone's mob.

They would? Got a link? I recall them objecting to that unspeakable shit Dutton deporting to NZ people who left it as children, have little or no memory of the place and no support network here. I also recall them objecting to the effective double jeopardy of deporting people who committed relatively minor crimes a long time ago and served their time for said crimes. And I recall them objecting to shit Dutton deporting people on the basis of guilt-by-association. I don't recall them ever characterising the people involved as "innocents abroad," although if they did describe the Aus government as "cruel and uncaring" they'd be well justified in doing so.

Er, yes. That's why Labour wanted the government to stir itself and try to dissuade its Australian counterpart from sending so many of them back here. The question is, why the government failed to give a shit - if Collins has some explanation for that, she can feel free to present it.

PM ...you know and I know that the decision was made by a sovereign parliament (unanimously). It applies not just to NZrs but anyone. Of course we don't want them here but there's nothing we can do because they are NZrs and not Australians. And of course the Australians don't want them and why should they ... nasty there and nasty here.

'By their actions you shall know them' ... got that from somewhere.

PM ... and further to the above. The appeal process IS working with a number of appellants who had returned to NZL (as opposed to waiting in Aust detention facilities pending process) being successful is persuading the authorities they deserved a second chance. Clearly the bad buggers remain and bad buggers they were and bad buggers they continue to be and Kelvin Davis is their poster-boy.

No information here to make a balanced decision. How many deported? How many of those are not offenders just "bad" characters? How many of the "around 30%" have family or connections to NZ? On what basis do the police think that 55% will re offend? How can anyone deported on character grounds "re offend"?

Please give details of systems put in place to help those who have nothing and no one to turn to on arrival.

The Veteran is a National party apparatchik and has been since birth and this post is just a smokescreen to launch a thinly disguised attack on Labours poster boy because he had the temerity to attack his poster girl.

Using statistics to lump every one together and to gloss over human failings to further a political cause shows a lack of compassion and the mind set of an apparatchik.

sure we could. amend the crimes act, withdraw from the UN moratorium on the death penalty, and shoot 'em all on arrival.

just passing the law would probably stop aussie deporting them anyway
